Course Overview

When an employee breaks the rules or repeats unacceptable behaviour, the decision can look quick and obvious. But the real question is not "what is the right penalty?" It is: what type of violation is this? Who has the authority to look at it? What procedure must come before the decision? This course teaches you to handle violations in an organised way, from classifying and analysing them to following the procedure, documenting it and deciding.

  • Understanding violations: administrative, financial and mixed violations, and how to tell them apart.
  • Procedures for each violation: how to look at each case according to its nature and circumstances.
  • Administrative penalties: the role of administrative committees, and the effect of a penalty on the employee and the organisation.
  • Violations and penalties policies: the rules for writing them, who applies which penalty, and the internal regulations on discipline and conduct.
  • Labour cases: the stages of a labour lawsuit between the organisation and the worker, and its key terms.
  • Reading labour court rulings: the legal terms in a ruling, and how it links to the facts of the case.
  • Compensation: how to read what a ruling awards and what follows from it.
  • Practical cases: case studies, group discussion and hands-on activities.

  • An employee committed a violation. How do we classify it before taking any action?
  • Is this an administrative violation, a financial one, or both?
  • Who should look into this violation?
  • What should our violations and penalties policy include?
  • We have a labour court ruling. How do we read it and understand what it decided?

You will not just learn what a violation is. You will learn to analyse it and handle it properly. In every case we practise six questions:

  • What actually happened?
  • What type of violation is it?
  • Who is the competent authority?
  • What procedure should be followed?
  • Which documents or regulations apply?
  • What is the effect of the decision once it is made?

How is the course taught and assessed?

Structured explanation, case studies, group discussion and practical activities. Assessment is through short quizzes during the course and a final test. You pass with a score of 50 or more.
